General Terms of Sales

1. Application

General conditions of sale are applicable to orders placed online through the shopping cart of the www.moinat.net website.

2. Customer Information

The customer undertakes to provide accurate personal information at the time of his or her order.

3. Pricing

All prices shown on www.moinat.net are net, including Swiss VAT (8%). When a different country is chosen during the ordering process, prices are shown excluding VAT, for export. A confirmation is sent after manual checking of the order and stock availability. For international deliveries, VAT and customs tariffs are payable to the shipping agent (Post, Carrier, etc.) if they do not appear on the order confirmation. Item prices on Moinat.net are in Swiss francs but can be shown in foreign currencies (euros, dollars, and pounds sterling) for the convenience of the customer. In the case of a calculation error in the current rate of exchange, the price in Swiss francs will prevail.

4. Delivery

For all purchases of 1,000 Swiss francs or more (in Switzerland; in France, Belgium and Germany, 1,000 euros or more), delivery is free of charge, up to 10% of the value of the order (price excluding tax).
For all orders with delivery costs greater than this offer, that maximum amount is deducted. This offer may not be combined with other occasional promotions (liquidation of stocks, sales, coupon codes, etc.).For all orders with delivery costs greater than this offer, the delivery costs are calculated as accurately as possible, and appear on the order confirmation. In the case of a dispute, the customer can designate the carrier of his or her choice, or the item shall be made available at our address at 1180 Rolle (Switzerland). In both cases, a period of 3 weeks applies, at the end of which the order is cancelled and the customer refunded, minus a 20% penalty on the amount of his or her order.

5. Special and Promotional Offers

Discounts and promotional offers are not cumulative. No price claims for any orders placed just before or just after a promotional period are accepted.

6. Offers

Representations of products on Moinat.net are without obligation. Following the order sent by the customer through the Moinat.net website, the customer receives a confirmation informing him or her that Charles-Emile Moinat & Fils SA has received his or her order. This confirmation from Charles-Emile Moinat & Fils SA does not constitute acceptance of the offer. Charles-Emile Moinat & Fils SA reserves the right to reject the request without mention of the reasons motivating their decision. A legally binding purchase agreement exists only when the order confirmation is sent by Charles-Emile Moinat & Fils SA. Unless otherwise stated in the item description, the article delivered corresponds to the photo and description shown on the site, subject to possible slight variations in color due to the quality of the photos, or to a possible error in the description.

7. Payment

The customer may make his or her purchase using the payment methods indicated on the Moinat.net website at the time of the order. The purchase price and any shipping costs are debited once the order is manually checked by Charles-Emile Moinat & Fils SA. If a delivery period is indicated, it begins from receipt of payment by Charles-Emile Moinat & Fils SA.
The items ordered are reserved from receipt of payment.

8. Warranty

All claims must be made within 10 days following receipt of the item concerned. Damages resulting from improper usage are excluded from the warranty.

9. Right of return

The customer has the right to return an item or items in cases which meet the following conditions: Within 10 days of receipt of the item concerned. The item must be returned with its original packaging, except in the case of bulk deliveries. Shipping costs and payment (minimum 10% of the amount invoiced in the order), as well as the costs of returning the merchandise, are the customer’s responsibility. This right of return is not applicable when ordering items benefitting from special conditions.

10. Place of Jurisdiction

In case of damage or claim, Charles-Emile Moinat & Fils SA and the customer undertake to seek direct contact first and foremost, in order to exhaust all other possibilities for conciliation and/or mediation before appealing to a court. Swiss law applies.
